Each EU country has national requirements that go beyond the EU Whistleblowing Directive, and Whistlelink ensures adherence to all relevant laws:
- Germany – The Hinweisgeberschutzgesetz (HinSchG), in force since 2 July 2023, strengthens protection against retaliation and explicitly allows anonymous reporting, which is not a mandatory requirement under the EU directive. Public institutions must also comply.
- Poland – The Ustawa o ochronie sygnalistów, effective 24 September 2024, requires companies to establish clear policies and provide training on whistleblower rights, going beyond the EU directive’s basic reporting channel requirement. It also enforces strict data confidentiality rules.
- Romania – Under LEGE nr. 361, in effect since 22 December 2022, all public institutions, regardless of size, must implement a whistleblowing system—exceeding the EU’s threshold for public sector organizations. The law also outlines detailed reporting obligations and penalties for non-compliance.
- Hungary – The 2023. évi XXV. törvény, adopted on 25 May 2023, broadens whistleblowing beyond legal violations to include ethical breaches, covering a wider scope than the EU directive.
