What is a certified communication?

Electronic Registered e-delivery service means a service that makes it possible to transmit data between third parties by electronic means and provides evidence relating to the handling of the transmitted data, including proof of sending and receiving the data. This kind of certification and control over the transmissions protects transmitted data against the risk of loss, theft, damage or any unauthorised alterations.

 

The legal consequence of that is stated in article 43 of eIDAS Regulation, “data sent and received using an electronic registered delivery service shall not be denied legal effect and admissibility as evidence in legal proceedings solely on the grounds that it is in an electronic form or that it does not meet the requirements of the qualified electronic registered delivery service”.

The use of a certified communication solution allows the admissibility of ERDS messages in judicial processes directly by EU Law (eIDAS). In fact, non-qualified registered delivery service providers are obliged to follow specific criteria set out by the Regulation itself about data processing and protection (art.5), the access to the service by person with disabilities and risk management. For this reason, certifying communications is the most appropriate process for all the use cases in which is important to have evidence of the time of transmission such as: · Changes of contractual conditions · Policy renewal notice · Preliminary negotiation notice · Payment reminders · Complaints Moreover, the use of a certified communication solution allows the user to eliminate shipping costs and to speed up processes, leveraging on a 100% digital solution.
Finally, the reduction of paper waste, with the resulting digital archiving and storage, ensures more sustainable processes for organisations; the possibility of being able to carry out operations completely remotely contributes to a reduction in frictional mobility and the CO2 emitted into the atmosphere.
